on Angiolini's role in non-prosecution
of alleged paedophile ring

The Firm has received a statement from the Crown Office claiming that Lord Advocate Elish Angiolini was not involved in the decision not to raise prosecution proceedings against an alleged paedophile ring whilst she was an Area Procurator Fiscal. A serving Sheriff was among those named in the allegations.

"These allegations relate to a case which was reported to the Procurator Fiscal in Aberdeen and dealt with before the Lord Advocate took up post as Regional Procurator Fiscal in 2000," the statement said.

"Grampian Police reported one person to the Procurator Fiscal and no criminal proceedings were instituted because there was insufficient evidence in law to prosecute. No allegation against any sheriff was made known to the Lord Advocate or to the senior Procurator Fiscal who dealt with the case at the time.

"This decision was taken before the Lord Advocate took up post as the Regional Procurator Fiscal for Grampian, Highland and Islands. The suggestion that she would be party to any attempt to pervert the course of justice in any case is one which the Lord Advocate regards as extremely serious and defamatory in nature."

The Firm have pressed the Crown Office to confirm the date the decision not to prosecute was taken. The alleged victim's mother stated that the police interviewed her daughter and were supplied with the names of her alleged abusers on 25 August 2000. Angiolini was appointed to the Regional Procurator Fiscal's post during July 2000, and the Firm has seen correspondence addressed directly to Angiolini dated 27 October 2000 from MSP Brian Adam, asking her what progress she had made with the case at that time.

The Lord Advocate has so far declined to comment directly on this matter.
